TERMS AND CONDITIONS

1. WHO WE ARE AND HOW TO CONTACT US

These Terms apply to all purchases made on boardgamist.com by consumers in the United Kingdom. They do not affect your statutory rights.

2. PLACING AN ORDER
2.1 When you place an order, you are offering to buy products from us. We’ll email you to acknowledge receipt. A contract is formed only when we email you a dispatch confirmation (the “Contract”).
2.2 If we cannot accept your order (for example, because the item is out of stock, a pricing error occurred, or we suspect fraud), we will cancel the order and refund any payment taken.
2.3 Images are for illustration. Components, colours and packaging may vary from those pictured. If you need exact edition details, please contact us before buying.

3. PRICES, TAX, PROMOTIONS AND ERRORS
3.1 Prices are in GBP and include VAT (where applicable). Delivery charges are shown at checkout.
3.2 We may change prices and offers at any time. Promotional prices apply only during the stated period and while stocks last.
3.3 Although we try to be accurate, obvious errors in price or description are not binding. If we discover an error after you order, we’ll contact you; you may cancel for a full refund or proceed at the correct price.

4. PAYMENT
4.1 We use secure third-party payment providers (e.g., PayPal). You must pay in full when placing your order. We do not store full card details.
4.2 To prevent fraud, we may verify your details with third-party databases. These checks confirm identity only and do not affect your credit rating.
4.3 Age-restricted products: it is an offence to purchase age-restricted titles if you, or the intended recipient, are under the required age.

5. DELIVERY
5.1 UK delivery only. Carriers include Royal Mail, Parcelforce and Evri (Hermes). Delivery dates are estimates, not guarantees.
5.2 In-stock items usually arrive within 3–5 working days after dispatch. Pre-orders dispatch when stock arrives. We cannot hold in-stock items pending pre-orders.
5.3 “24-Hour Tracked / Next Business Day” dispatch rules:
• Orders received before 12:00 (Mon–Fri) usually dispatch the same day for next business day delivery.
• Orders after 12:00 dispatch the next working day.
• Weekends and bank holidays are excluded.
• Severe weather/industrial action may disrupt services; no compensation is offered for late delivery due to events beyond our control.
• Service availability depends on your UK address.
5.4 Risk in products passes to you on delivery. Title passes when we receive full payment.

6. CANCELLATIONS (CHANGE OF MIND) – CONSUMER CONTRACTS REGULATIONS 2013
6.1 You have 14 days from the day after delivery to change your mind and cancel your order (“cooling-off period”).
6.2 To cancel, email us at admin@boardgamist.com with your order number and a clear statement. You must send back the goods within 14 days of telling us you’re cancelling.
6.3 You are responsible for return postage costs for change-of-mind returns.
6.4 We will refund the product price and the standard delivery cost (if the whole order is returned) within 14 days of receiving the goods back (or receiving evidence you have sent them). We refund using your original payment method.
6.5 You may inspect the goods as you would in a shop. We may deduct for any loss in value caused by unnecessary handling (e.g., opened shrink wrap, missing components, damage).

7. FAULTY, DAMAGED OR INCORRECT ITEMS – CONSUMER RIGHTS ACT 2015
7.1 If your item is faulty, damaged in transit, or not as described, contact us at admin@boardgamist.com as soon as possible (ideally within 30 days). We may request photos to speed up resolution.
7.2 Your legal rights include:
• Up to 30 days: short-term right to reject for a refund.
• Up to 6 months: one repair or replacement; if unsuccessful, you’re entitled to a refund in most cases.
• Up to 6 years: you may be entitled to a remedy if goods do not last a reasonable time.
7.3 For faults, we’ll cover return postage or provide a prepaid label. Where appropriate we’ll offer repair, replacement, or refund.

8. RETURNS PROCESS (ALL CASES)
8.1 Email us first for return instructions and the correct return address.
8.2 Pack goods securely with all components, manuals and packaging. Include your order number and contact details.
8.3 Keep proof of posting. You are responsible for the goods until they reach us, unless we arranged the return.

9. GIFT VOUCHERS AND REWARDS
9.1 Using a Boardgamist gift voucher constitutes acceptance of these Terms. Vouchers cannot be exchanged for cash or used to buy other vouchers.
9.2 Treat vouchers like cash; we are not responsible for lost or stolen vouchers.
9.3 If you return an item bought with a voucher, the refund is issued as a voucher (any cash co-payment is refunded to the original method).
9.4 Reward points are earned only when you are logged in; they cannot be added retrospectively. Promo codes have expiry dates and may be withdrawn.

10. USER CONTENT (REVIEWS, COMMENTS, FEEDBACK)
10.1 You are responsible for content you submit. Do not post anything unlawful, defamatory, obscene, infringing, or harmful (including malware).
10.2 By submitting content, you grant us a non-exclusive, royalty-free licence to use, reproduce, and publish it for marketing and site operations. We may moderate or remove content at our discretion.

11. INTELLECTUAL PROPERTY
11.1 All site content (text, images, logos) is owned by or licensed to us and may be used for personal, non-commercial purposes only. Do not copy or exploit without our permission.
11.2 Product names and artwork are the property of their respective owners and used under licence or fair dealing.

12. WEBSITE INFORMATION
12.1 We try to ensure our website is accurate and up to date, but errors may occur. We may correct errors, change or update information, or cancel orders affected by material errors (with a full refund).
12.2 If you need precise edition/components details, please ask before purchase.

13. COMPETITIONS AND GIVEAWAYS
13.1 No purchase necessary unless stated. Prizes have no cash value and are non-transferable.
13.2 Opening/closing dates and entry rules will be stated where the promotion is advertised. Winners are chosen at random and contacted via the channel used to enter (e.g., Instagram, Facebook or email).
13.3 Winners have 7 days to claim the prize; otherwise we may select another winner.
13.4 Our promotions are not sponsored, endorsed or administered by Instagram or Facebook.
13.5 UK entrants aged 13+ may enter (13–17 with parent/guardian consent). We will take reasonable steps to verify eligibility.
13.6 We will handle personal data submitted for promotions in accordance with our Privacy & Cookie Policy.

14. LIABILITY
14.1 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability which cannot legally be limited or excluded.
14.2 We are not responsible for:
• losses not caused by our breach;
• losses that were not foreseeable by you and us at the time of the Contract; or
• business losses (we sell to consumers only).
14.3 We are not liable for delays or failures caused by events outside our reasonable control. We will take reasonable steps to minimise the effect.

15. COMPLAINTS AND DISPUTE RESOLUTION
15.1 We aim to resolve issues quickly and fairly. Contact: admin@boardgamist.com or 07727 113598.
15.2 If we cannot resolve a dispute, we will provide information about alternative dispute resolution (ADR) options. Use of ADR is voluntary.
15.3 You can bring proceedings in the courts of the part of the UK where you live. English law applies, but you will benefit from any mandatory consumer protections of your home jurisdiction within the UK.

16. PRIVACY AND COOKIES
Your submission of personal information is governed by our Privacy & Cookie Policy (see site footer). Non-essential cookies are used only with your consent and can be managed via the cookie settings link.

17. CHANGES TO THESE TERMS
We may update these Terms from time to time by posting a new version on the website. The version in force when you order applies to that order.
